These Terms & Conditions ("Terms") govern your use of Magic Sort: Color Water Puzzle for iPhone (the "Game"), published by Apexa Pambhar ("we", "us"). By downloading or playing the Game, you agree to these Terms. If you do not agree, do not use the Game.
1. Apple's Standard EULA
The Game is licensed, not sold, to you through the Apple App Store. Your use is also subject to Apple's Licensed Application End User License Agreement ("Standard EULA") and the App Store Terms of Service. If these Terms conflict with the Standard EULA, the Standard EULA applies to the extent of the conflict.
2. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the Game on Apple devices that you own or control, as allowed by the App Store's Usage Rules. You may not copy, modify, reverse engineer, decompile, rent, sell or redistribute the Game, except where the law expressly allows it.
3. Ads
The Game is free to download and is supported by banner, full-screen (interstitial) and optional rewarded video ads served by Google AdMob. We don't control the content of individual ads and are not responsible for advertisers' products, services or websites. Tapping an ad may open another app or website, which has its own terms. How ad data is handled, and your consent choices, are explained in our Privacy Policy.
Rewarded videos, such as a short video in the Shop for free coins, are always optional. A reward is added only after the video has played to the end. If an ad doesn't load, is closed early or is interrupted, no reward is given. Rewarded ads need an internet connection, may not always be available, and we may change or limit the rewards they give.
4. In-app purchases
The Game sells optional in-app purchases. What each one includes and its price are shown in the Game before you buy.
- Coin packs are consumable: the coins are added to your balance and used up when you spend them.
- The Starter Pack can be bought only once.
- Remove Ads is a one-time purchase that removes banner and full-screen (pop-up) ads. Optional rewarded videos stay available for when you choose to watch one.
- All payments are processed by Apple and charged to your Apple Account. Prices may vary by country and may change. A price change never affects a purchase you have already made.
- On another device or after reinstalling, sign in with the same Apple Account, open the Shop and tap Restore purchases to get Remove Ads and the Starter Pack back. Coin packs are consumable and can't be restored.
- Refunds are handled by Apple under its policies. You can request one at reportaproblem.apple.com. We cannot issue refunds directly.
5. Coins and other virtual items
Coins, tools, chests and other in-game items ("Virtual Items") are part of the Game's license. They have no real-world value, are not your property, and can't be exchanged for money, sold, transferred or traded, inside or outside the Game. You can use them only in the Game. We may change how Virtual Items are earned, priced or used, for example to keep the Game balanced. Except where the law or Apple's refund policy requires otherwise, Virtual Items are not refundable, including when they are lost because you deleted the Game.
6. Fair play
Please play the Game as intended. You agree not to cheat, use modified versions of the Game, exploit bugs, or use tools or tricks (such as changing your device's clock) to get Virtual Items or rewards you haven't earned. Updates may fix such issues and correct in-game balances that resulted from them.
7. Your progress
Your progress and Virtual Items are saved only on your device, not on our servers. They stay when you update the Game, but they are removed if you delete the Game, and they are not backed up or synced between devices. If they are lost, we cannot restore them. Purchases you can restore are listed in section 4.
8. Third-party services
Ads and the consent form are provided by Google through the Google Mobile Ads SDK and Google's User Messaging Platform, and purchases are processed by Apple. These services are subject to their providers' own terms. We are not responsible for their availability or content.
9. Our intellectual property
The Game, including its design, code, levels, artwork, sounds and text, is owned by Apexa Pambhar and protected by copyright and other laws. These Terms do not give you any rights to our trademarks.
10. Privacy
Our Privacy Policy explains how the Game handles information. In short: your progress stays on your device, the Game never asks to track you, and ads are provided by Google AdMob.
11. Updates and availability
We may release updates to fix bugs, add or change levels and features, adjust rewards and prices, or support new iOS versions. Some updates may be required to keep playing. We may stop offering or supporting the Game at any time, but this will not remove a copy you have already downloaded.
12. Disclaimer of warranties
To the maximum extent allowed by law, the Game is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Game will be uninterrupted or error-free, or that ads or rewards will always be available. If the Game fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); Apple has no other warranty obligation regarding the Game.
13. Limitation of liability
To the maximum extent allowed by law, Apexa Pambhar will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of progress, Virtual Items, data, profits or business, arising from your use of or inability to use the Game. Our total liability for any claim relating to the Game will not exceed the amount you paid for the Game and its in-app purchases in the 12 months before the claim. Some jurisdictions do not allow these limits, so they may not apply to you.
14. Indemnity
You agree to indemnify and hold Apexa Pambhar harmless from claims arising from your misuse of the Game or your violation of these Terms or of any law or third-party right.
15. Apple-specific terms
These Terms are between you and Apexa Pambhar, not Apple. Apple is not responsible for the Game or its content, has no obligation to provide maintenance or support for it, and is not responsible for addressing any claims relating to the Game, including product liability, legal or regulatory compliance, consumer protection or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.
16. Termination
Your license ends automatically if you breach these Terms. When it ends, you must stop using the Game and delete it from your devices, and any Virtual Items you have are lost.
17. Governing law
These Terms are governed by the laws of India, without regard to conflict-of-law rules. Any dispute will be handled by the competent courts of India, unless the consumer protection laws of your country give you the right to bring proceedings where you live.
18. Changes to these Terms
We may update these Terms from time to time. We will change the effective date above, and continued use of the Game after a change means you accept the updated Terms.
