These Terms & Conditions ("Terms") govern your use of the Photo Cleaner app for iPhone and iPad (the "App") published by Apexa Pambhar ("we", "us"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Apple's Standard EULA
The App is licensed, not sold, to you through the Apple App Store. Your use is also subject to Apple's Licensed Application End User License Agreement ("Standard EULA") and the App Store Terms of Service. If these Terms conflict with the Standard EULA, the Standard EULA applies to the extent of the conflict.
2. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices that you own or control, as allowed by the App Store's Usage Rules. You may not copy, modify, reverse engineer, decompile, rent, sell or redistribute the App, except where the law expressly allows it.
3. Deleting photos is your decision
The App helps you choose photos and videos to remove, and suggests groups such as duplicates, similar shots and blurry photos, including a suggested best shot. Suggestions can be wrong. You decide what to delete: nothing is removed until you review your choices and confirm, and iOS asks you again. Deleted items go to Recently Deleted in the Photos app, where they can be recovered for about 30 days; after that, or if you empty Recently Deleted, they are gone for good. Deleting a photo in a library synced with iCloud Photos also deletes it on your other devices. Keep a backup of photos that matter to you. We are not responsible for photos you choose to delete.
4. Ads
The App is free to download and, for users without Pro, is supported by ads served by Google AdMob: a banner on content screens, and a full-screen video ad after every 50 delete swipes. We don't control the content of individual ads and are not responsible for advertisers' products, services or websites. Tapping an ad may open another app or website, which has its own terms. How ad data is handled, and how to change your tracking and consent choices, is explained in our Privacy Policy. Your photos are never used for ads.
5. Pro plans and subscriptions
Photo Cleaner Pro removes all ads. It is offered as a weekly, monthly or yearly auto-renewing subscription, or as a one-time lifetime purchase. Prices are shown in the App before you buy and may vary by country. There are no free trials.
- Payment is charged to your Apple Account when you confirm the purchase.
- Subscriptions renew automatically at the same price for the same period unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the period ends.
- Cancel or change a plan at any time in iOS Settings › [your name] › Subscriptions, or from Manage or cancel subscription in the App. Cancelling stops future renewals; Pro stays active until the end of the period you paid for.
- Lifetime is a one-time purchase that never renews.
- Restore Pro on a new or reset device with the same Apple Account using Restore purchases in the App's Settings.
- Refunds are handled by Apple under its policies. You can request one at reportaproblem.apple.com. We cannot issue refunds directly.
6. Acceptable use
Use the App only with photo libraries you are allowed to manage. Don't use it on someone else's device or library without their permission.
7. Third-party services
The App works with Apple's Photos, iCloud Photos, widgets and notifications, and uses ads and the consent form from Google through the Google Mobile Ads SDK and Google's User Messaging Platform. Purchases are processed by Apple. These services are subject to their providers' own terms, and we are not responsible for their availability or content.
8. Our intellectual property
The App, including its design, code, name, logo, icons and graphics, is owned by Apexa Pambhar and protected by copyright, trademark and other laws. These Terms do not give you any rights to our trademarks.
9. Privacy
Our Privacy Policy explains how the App handles information. In short: your photos never leave your device, and the ads, provided by Google AdMob, follow your tracking and consent choices without ever seeing your photos.
10. Updates and availability
We may release updates to fix bugs, add or change features, or support new iOS versions. Some updates may be required to keep using the App. We may stop offering or supporting the App at any time, but this will not remove a copy you have already downloaded. If we stop offering Pro, existing subscriptions can be cancelled as described above.
11. Disclaimer of warranties
To the maximum extent allowed by law, the App is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not guarantee that the App will be uninterrupted or error-free, or that its suggestions (such as duplicates, similar or blurry photos and best shots) will be correct. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); Apple has no other warranty obligation regarding the App.
12. Limitation of liability
To the maximum extent allowed by law, Apexa Pambhar will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of photos, videos, data, profits or business, arising from your use of or inability to use the App, including photos you chose to delete. Our total liability for any claim relating to the App will not exceed the amount you paid for the App and Pro in the 12 months before the claim. Some jurisdictions do not allow these limits, so they may not apply to you.
13. Indemnity
You agree to indemnify and hold Apexa Pambhar harmless from claims arising from your misuse of the App or your violation of these Terms or of any law or third-party right.
14. Apple-specific terms
These Terms are between you and Apexa Pambhar, not Apple. Apple is not responsible for the App or its content, has no obligation to provide maintenance or support for it, and is not responsible for addressing any claims relating to the App, including product liability, legal or regulatory compliance, consumer protection or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.
15. Termination
Your license ends automatically if you breach these Terms. When it ends, you must stop using the App and delete it from your devices. Deleting the App doesn't cancel a subscription; cancel it as described in section 5.
16. Governing law
These Terms are governed by the laws of India, without regard to conflict-of-law rules. Any dispute will be handled by the competent courts of India, unless the consumer protection laws of your country give you the right to bring proceedings where you live.
17. Changes to these Terms
We may update these Terms from time to time. We will change the effective date above, and continued use of the App after a change means you accept the updated Terms.
