These Terms & Conditions ("Terms") govern your use of the GeoStamp iOS app (the "App") published by DevAppStudio ("we", "us"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Apple's Standard EULA
The App is licensed, not sold, to you through the Apple App Store. Your use is also subject to Apple's Licensed Application End User License Agreement ("Standard EULA") and the App Store Terms of Service. If these Terms conflict with the Standard EULA, the Standard EULA applies to the extent of the conflict.
2. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices that you own or control, as allowed by the App Store's Usage Rules. You may not copy, modify, reverse engineer, decompile, rent, sell or redistribute the App, except where the law expressly allows it.
3. Price, payment and refunds
The App is a paid, one-time purchase through the App Store, with no subscription. Prices are shown on the App Store and may change. All payments are processed by Apple, and refunds are handled by Apple under its policies. You can request one at reportaproblem.apple.com. We cannot issue refunds directly.
4. Acceptable use
You agree to use the App lawfully and responsibly. In particular, you will not:
- Use the App to create photos with false or misleading locations, dates or times intended to deceive, defraud or mislead any person, employer, insurer, court or authority. Photos made with the custom location feature show a location you entered, not where the photo was taken.
- Photograph people, private property or restricted areas where doing so is illegal or violates someone's privacy.
- Use the App while driving or in any way that puts you or others in danger.
- Try to interfere with, or extract data in bulk from, the Apple services the App uses.
You are solely responsible for the photos you take and how you use or share them.
5. Accuracy of location, time and weather
Stamp information comes from your device's GPS and sensors and from Apple Maps and Apple Weather. It can be inaccurate or unavailable, for example indoors, near tall buildings, without a network connection, or if your device's clock or settings are wrong. The App is provided as a convenience and is not a certified evidence, surveying, navigation or legal record-keeping tool. Do not rely on it as the only record where accuracy is critical. Always verify important information.
6. Your content
Photos and data you create with the App belong to you. They are stored on your device, and we do not receive or store them. You are responsible for backing them up, for example with iCloud Photos. Deleting the App deletes the photos held inside the App's own Collection; copies saved to your photo library remain.
7. Third-party services
The App uses Apple services, including Apple Maps and Apple Weather, which are subject to Apple's own terms. Map data © Apple and its data providers. Weather data provided by Apple Weather. We are not responsible for the availability or accuracy of third-party services.
8. Intellectual property
The App, including its design, code, name, logo, stamp layouts and graphics, is owned by DevAppStudio and protected by copyright, trademark and other laws. These Terms do not give you any rights to our trademarks.
9. Privacy
Our Privacy Policy explains how the App handles information. In short: your data stays on your device.
10. Updates and availability
We may release updates to fix bugs, add or change features, or support new iOS versions. Some updates may be required to keep using the App. We may stop offering or supporting the App at any time, but this will not remove a copy you have already downloaded.
11. Disclaimer of warranties
To the maximum extent allowed by law, the App is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not guarantee that the App will be uninterrupted, error-free, or that stamped information will be accurate. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price; Apple has no other warranty obligation regarding the App.
12. Limitation of liability
To the maximum extent allowed by law, DevAppStudio will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, photos, profits or business, arising from your use of or inability to use the App, including reliance on location, time or weather information. Our total liability for any claim relating to the App will not exceed the amount you paid for the App. Some jurisdictions do not allow these limits, so they may not apply to you.
13. Indemnity
You agree to indemnify and hold DevAppStudio harmless from claims arising from your misuse of the App or your violation of these Terms or of any law or third-party right.
14. Apple-specific terms
These Terms are between you and DevAppStudio, not Apple. Apple is not responsible for the App or its content, has no obligation to provide maintenance or support for it, and is not responsible for addressing any claims relating to the App, including product liability, legal or regulatory compliance, consumer protection or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.
15. Termination
Your license ends automatically if you breach these Terms. When it ends, you must stop using the App and delete it from your devices.
16. Governing law
These Terms are governed by the laws of India, without regard to conflict-of-law rules. Any dispute will be handled by the competent courts of India, unless the consumer protection laws of your country give you the right to bring proceedings where you live.
17. Changes to these Terms
We may update these Terms from time to time. We will change the effective date above, and continued use of the App after a change means you accept the updated Terms.
