These Terms & Conditions ("Terms") govern your use of Cat Nap: Logic Puzzle for iPhone and iPad (the "Game"), published by Apexa Pambhar ("we", "us"). By downloading or playing the Game, you agree to these Terms. If you do not agree, do not use the Game.
1. Apple's Standard EULA
The Game is licensed, not sold, to you through the Apple App Store. Your use is also subject to Apple's Licensed Application End User License Agreement ("Standard EULA") and the App Store Terms of Service. If these Terms conflict with the Standard EULA, the Standard EULA applies to the extent of the conflict.
2. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the Game on Apple devices that you own or control, as allowed by the App Store's Usage Rules. You may not copy, modify, reverse engineer, decompile, rent, sell or redistribute the Game, except where the law expressly allows it.
3. Ads
The free version of the Game is supported by ads served by Google AdMob. We don't control the content of individual ads and are not responsible for advertisers' products, services or websites. Tapping an ad may open another app or website, which has its own terms. How ad data is handled, and your consent choices, are explained in our Privacy Policy.
4. Remove Ads
The optional in-app purchase "Remove Ads" stops the Game from loading ads. Its price is shown in the Game before you buy.
- Remove Ads is a one-time purchase, not a subscription. You will not be charged again for it.
- It also works for your Family Sharing group.
- All payments are processed by Apple and charged to your Apple Account. Prices may vary by country and may change. A price change never affects a purchase you have already made.
- On another device or after reinstalling, sign in with the same Apple Account and open Settings → Purchases → Restore purchases to get Remove Ads back.
- Refunds are handled by Apple under its policies. You can request one at reportaproblem.apple.com. We cannot issue refunds directly.
5. Hints, hearts and streaks
Hints, hearts, streaks and other in-game items are part of the Game's license. They have no real-world value, are not your property, and can't be exchanged for money, sold, transferred or traded. We may change how they work, for example to keep the Game balanced.
6. Fair play
Please play the Game as intended. You agree not to cheat, use modified versions of the Game, exploit bugs, or use tricks (such as changing your device's clock) to extend streaks you haven't earned. Updates may fix such issues.
7. Your progress
Your progress is saved only on your device and in your iPhone or iPad backup, not on our servers. Restoring a backup to a new device brings it back. If you delete the Game without a backup, your progress is lost and we cannot restore it.
8. Third-party services
Ads and the consent message are provided by Google through the Google Mobile Ads SDK and Google's User Messaging Platform, and purchases are processed by Apple. These services are subject to their providers' own terms. We are not responsible for their availability or content.
9. Our intellectual property
The Game, including its design, code, puzzles, artwork, sounds and text, is owned by Apexa Pambhar and protected by copyright and other laws. These Terms do not give you any rights to our trademarks.
10. Privacy
Our Privacy Policy explains how the Game handles information. In short: your progress stays on your device, the Game never asks to track you, and ads are provided by Google AdMob.
11. Updates and availability
We may release updates to fix bugs, add or change puzzles and features, or support new iOS versions. Some updates may be required to keep playing. We may stop offering or supporting the Game at any time, but this will not remove a copy you have already downloaded.
12. Disclaimer of warranties
To the maximum extent allowed by law, the Game is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Game will be uninterrupted or error-free. If the Game fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); Apple has no other warranty obligation regarding the Game.
13. Limitation of liability
To the maximum extent allowed by law, Apexa Pambhar will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of progress, data, profits or business, arising from your use of or inability to use the Game. Our total liability for any claim relating to the Game will not exceed the amount you paid for the Game and Remove Ads. Some jurisdictions do not allow these limits, so they may not apply to you.
14. Indemnity
You agree to indemnify and hold Apexa Pambhar harmless from claims arising from your misuse of the Game or your violation of these Terms or of any law or third-party right.
15. Apple-specific terms
These Terms are between you and Apexa Pambhar, not Apple. Apple is not responsible for the Game or its content, has no obligation to provide maintenance or support for it, and is not responsible for addressing any claims relating to the Game, including product liability, legal or regulatory compliance, consumer protection or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.
16. Termination
Your license ends automatically if you breach these Terms. When it ends, you must stop using the Game and delete it from your devices.
17. Governing law
These Terms are governed by the laws of India, without regard to conflict-of-law rules. Any dispute will be handled by the competent courts of India, unless the consumer protection laws of your country give you the right to bring proceedings where you live.
18. Changes to these Terms
We may update these Terms from time to time. We will change the effective date above, and continued use of the Game after a change means you accept the updated Terms.
