These Terms & Conditions ("Terms") govern your use of the DotBloom: Connect the Dots app for iPhone and iPad (the "App") published by Apexa Pambhar ("we", "us"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Apple's Standard EULA
The App is licensed, not sold, to you through the Apple App Store. Your use is also subject to Apple's Licensed Application End User License Agreement ("Standard EULA") and the App Store Terms of Service. If these Terms conflict with the Standard EULA, the Standard EULA applies to the extent of the conflict.
2. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices that you own or control, as allowed by the App Store's Usage Rules. You may not copy, modify, reverse engineer, decompile, rent, sell or redistribute the App, except where the law expressly allows it.
3. Free to play, with ads
The App is free to download and play. It is supported by advertising served by Google AdMob, as explained in our Privacy Policy. Ads are provided by third parties, and we are not responsible for the content of ads or for the products and websites they link to. If you see an ad you think is inappropriate, please tell us through the support page.
4. Coins, boosters and in-app purchases
- The App uses virtual coins that you earn by playing or can buy in optional coin packs. Coins can be spent only on in-game items such as boosters.
- Coins and boosters are a limited license to use in-game content. They have no cash value, cannot be exchanged for money or real goods, and cannot be transferred or sold.
- Coin packs are consumable purchases. Once added, coins are not restored if you spend them, reset your progress or delete the App.
- All payments are processed by Apple, and refunds are handled by Apple under its policies. You can request one at reportaproblem.apple.com. We cannot issue refunds directly.
- Prices are shown on the App Store and may change. We may change in-game prices, rewards and balance to keep the game fair and fun.
5. Acceptable use
You agree to use the App lawfully and fairly. In particular, you will not:
- Cheat, exploit bugs, or use modified versions of the App or third-party tools to change scores, coins or progress.
- Submit manipulated scores to Game Center leaderboards, or use offensive Game Center names.
- Click ads deliberately or repeatedly to generate false ad activity, or interfere with how ads are shown.
- Use the App in any way that puts you or others in danger, for example while driving.
We may reset scores or progress that result from cheating or abuse.
6. Your progress
Your progress is stored on your device and synced through your iCloud account when you're signed in. We do not store it and cannot recover it. Progress can be lost if you reset it, sign out of iCloud, or delete the App without iCloud enabled.
7. Third-party services
The App uses Apple services (iCloud, Game Center, App Store) and Google AdMob, which are subject to their own terms. We are not responsible for the availability or behaviour of third-party services.
8. Intellectual property
The App, including its design, code, name, logo, levels, sounds and graphics, is owned by Apexa Pambhar and protected by copyright, trademark and other laws. These Terms do not give you any rights to our trademarks.
9. Privacy
Our Privacy Policy explains how the App handles information, including advertising data.
10. Updates and availability
We may release updates to fix bugs, add or change features, levels or modes, or support new iOS versions. Some updates may be required to keep using the App. We may stop offering or supporting the App at any time, but this will not remove a copy you have already downloaded.
11. Disclaimer of warranties
To the maximum extent allowed by law, the App is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the App will be uninterrupted or error-free. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; Apple has no other warranty obligation regarding the App.
12. Limitation of liability
To the maximum extent allowed by law, Apexa Pambhar will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, progress, coins, profits or business, arising from your use of or inability to use the App. Our total liability for any claim relating to the App will not exceed the amount you paid us through in-app purchases in the 12 months before the claim. Some jurisdictions do not allow these limits, so they may not apply to you.
13. Indemnity
You agree to indemnify and hold Apexa Pambhar harmless from claims arising from your misuse of the App or your violation of these Terms or of any law or third-party right.
14. Apple-specific terms
These Terms are between you and Apexa Pambhar, not Apple. Apple is not responsible for the App or its content, has no obligation to provide maintenance or support for it, and is not responsible for addressing any claims relating to the App, including product liability, legal or regulatory compliance, consumer protection or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.
15. Termination
Your license ends automatically if you breach these Terms. When it ends, you must stop using the App and delete it from your devices.
16. Governing law
These Terms are governed by the laws of India, without regard to conflict-of-law rules. Any dispute will be handled by the competent courts of India, unless the consumer protection laws of your country give you the right to bring proceedings where you live.
17. Changes to these Terms
We may update these Terms from time to time. We will change the effective date above, and continued use of the App after a change means you accept the updated Terms.
